AFT Warranty and RMA Policy

WARRANTY

Atech Flash Technology, Inc. (“AFT”) provides limited manufacturer’s warranty coverage for its products as described below.

Consumer Reader Products
AFT Consumer Reader products are backed by a one (1) year limited manufacturer’s warranty from the original date of purchase.

AFT warrants to the original end user (“Consumer”) that, under normal intended use, AFT flash memory card readers will be free from defects in materials and workmanship for one (1) year from the date of purchase.

During the applicable warranty period, AFT will, at its option, repair or replace a product determined by AFT to be defective in materials or workmanship.

AFT shall not be liable for any loss or damage resulting from the use or inability to use an AFT product, or for any data, files, photographs, or other content stored on media or devices returned to AFT for service. AFT does not provide any express or implied warranty against the loss of data or images.

Customers must provide valid proof of purchase and obtain warranty service authorization from AFT within the applicable warranty period before returning a defective product.

Returned products must be shipped prepaid and packaged appropriately to prevent damage during transportation. AFT recommends using an insured and trackable shipping method. AFT is not responsible for returned products that are lost, stolen, or damaged before they are received by AFT.

Product registration is recommended to help expedite warranty service but is not a substitute for valid proof of purchase.

Consumer Electronic Products

AFT Consumer Electronic products are backed by a ninety (90) day limited manufacturer’s warranty from the original date of purchase.

AFT warrants to the original end user (“Customer”) that, under normal intended use, the product will be free from defects in materials and workmanship for ninety (90) days from the date of purchase.

During the applicable warranty period, AFT will, at its option, repair or replace a product determined by AFT to be defective in materials or workmanship.

The same warranty limitations, proof-of-purchase requirements, data-loss limitations, and return requirements described in this Warranty Policy apply to AFT Consumer Electronic products.

Kiosk Reader Products
Standard AFT Kiosk Reader products are backed by a one (1) year limited manufacturer’s warranty.

For products purchased directly from AFT by distributors, resellers, system integrators, or other commercial customers, the warranty period begins on the applicable AFT invoice date unless otherwise agreed to in writing.

During the applicable warranty period, AFT will, at its option, repair or replace a product determined by AFT to be defective in materials or workmanship.

OEM, Custom, Professional, and Contract-Specific Products

Products sold under an OEM, custom development, project-specific, reseller, distributor, or other written customer/vendor agreement may be subject to warranty terms that differ from AFT’s standard warranty.

If a written agreement expressly specifies warranty coverage, warranty duration, service obligations, technical support obligations, or other warranty-related terms, the applicable written agreement will govern those matters.

If no different warranty terms are specified in a written agreement, AFT’s standard warranty applicable to the product category will apply.

A reseller or distributor may independently provide additional warranty or service coverage to its own customers. Any such additional coverage is the responsibility of the reseller or distributor and does not expand AFT’s warranty obligations unless AFT expressly agrees to such terms in writing.

WARRANTY LIMITATIONS

This limited warranty applies only to defects in materials or workmanship occurring under normal intended use.

The warranty does not apply to damage or failure resulting from:

Accident, abuse, misuse, or neglect
Improper installation or operation
Unauthorized modification, disassembly, or repair
Improper electrical power or connection
Lightning, fire, water, flood, or other external causes or acts of nature
Normal wear and tear
Damage occurring during transportation to AFT
Removal, alteration, or tampering with the product serial number or identification label

To the extent permitted by applicable law, this limited warranty is in lieu of all other warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.

To the extent permitted by applicable law, AFT shall not be liable for any special, incidental, indirect, or consequential damages resulting from the possession, use, inability to use, or failure of an AFT product.

Some jurisdictions do not allow certain exclusions or limitations of implied warranties or incidental or consequential damages. Therefore, some of these limitations may not apply to you.

MEDIA CARD COMPATIBILITY

Compatibility and performance may vary depending on the media card, card manufacturer, card capacity, firmware, operating system, host computer, and other system conditions.

If a media card does not operate properly with an AFT product, please contact AFT Technical Support for compatibility information and information regarding available firmware, drivers, or other updates.

Media card formats referenced herein include CFexpress®, CFast® 2.0, RED MINI-MAG®, XQD®, SxS™, CompactFlash®, Memory Stick™, SD™ and microSD memory cards, SmartMedia™, Microdrive™, and xD-Picture Card™. All trademarks and registered trademarks are the property of their respective owners.

RMA POLICY

This RMA Policy applies to products sold by Atech Flash Technology.

Products purchased through other sources may be eligible for RMA service subject to verification and written authorization by AFT.

RMA AUTHORIZATION

An RMA number must be obtained from AFT before returning a product.

The following information may be required:

AFT invoice number and invoice date, or other valid proof of purchase
Product model number
Product serial number, if applicable
Description of the reported problem

Products returned without prior RMA authorization may be refused or subject to additional handling charges.

CREDITS AND EXCHANGES

RMA returns are generally accepted for repair or replacement only.

If requested within fifteen (15) days of the AFT invoice date, AFT may, at its discretion, authorize a credit or exchange.

Restocking, handling, or other applicable charges may be assessed for authorized credits or exchanges, particularly when the return is outside the initial fifteen (15) day period or does not comply with AFT’s return procedures.

SHIPPING TO AFT

All authorized RMA products must be shipped freight prepaid to the AFT location specified in the RMA authorization.

The RMA number must be clearly displayed on the shipping label or outer packaging.

Products should be appropriately packaged to prevent shipping damage. AFT recommends using a shipping method that provides insurance and tracking.

The sender is responsible for the product until it is received by AFT.

RETURN SHIPPING

For products confirmed by AFT to be defective and covered under warranty, AFT will pay standard return shipping charges to the Purchaser within the applicable domestic service area.

Unless otherwise agreed to in writing, international shipping costs, duties, taxes, customs charges, brokerage fees, and other import or export expenses are the responsibility of the customer, purchaser, reseller, or distributor.

Shipping and handling charges may be assessed for products that:

Are determined not to be defective;
Are not covered under warranty;
Are counterfeit or non-genuine AFT products; or
Are products manufactured or branded by another company.

Such products may be refused or returned to the sender at the sender’s expense.

REPAIR SCHEDULE

AFT will make reasonable efforts to complete standard RMA repairs within fifteen (15) business days after receipt of the returned product.

Larger quantity returns, including shipments exceeding fifty (50) units, may require twenty (20) business days or longer depending on product condition, replacement-part availability, testing requirements, and other circumstances.

If a product cannot reasonably be repaired, AFT may, at its option, provide a replacement product.

Repair and replacement time frames are estimates and are not guaranteed unless otherwise agreed to in writing.

OUT-OF-WARRANTY SERVICE

AFT may provide out-of-warranty repair services for certain products.

Customers should contact the AFT RMA Department for current service availability, repair charges, shipping charges, handling charges, and other applicable fees.

POLICIES, PROCEDURES, AND SERVICE CHARGES ARE SUBJECT TO CHANGE WITHOUT NOTICE.

LIMITED WARRANTY FOR COMMERCIAL AND WHOLESALE CUSTOMERS

This Limited Warranty applies to eligible wholesale, distributor, reseller, system integrator, and other commercial customers (“Purchasers”) who purchase products directly from Atech Flash Technology.

Unless otherwise stated in a written agreement or applicable product warranty, AFT warrants eligible products to be free from defects in materials and workmanship under normal intended use for twelve (12) months from the applicable AFT invoice date.

If an eligible product is determined by AFT to be defective during the applicable warranty period, AFT will, at its option, repair or replace the product without charge for covered parts or labor.

This Limited Warranty does not apply if:

(a) the product is damaged by accident, improper installation, misuse, abuse, neglect, improper power, lightning, fire, water, or other external causes or acts of nature;

(b) the product has been altered, modified, disassembled, or repaired by anyone other than AFT or an AFT-authorized service provider;

(d) the failure results from normal wear and tear or conditions outside the product’s intended operating specifications.

To obtain warranty service, the Purchaser must provide reasonable evidence of the purchase date. AFT recommends retaining the original AFT invoice as evidence of the purchase date and applicable product information.

The Purchaser’s exclusive remedy under this Limited Warranty is repair or replacement of the defective product as provided above.

To the extent permitted by applicable law, AFT shall not be liable for any direct, indirect, incidental, special, or consequential loss or damage arising from the inability to use the product, including loss of data, revenue, profit, or business opportunity.

This Limited Warranty is in lieu of all other warranties, express or implied, including, to the extent permitted by applicable law, warranties of merchantability and fitness for a particular purpose.

No reseller, distributor, representative, employee, or other party is authorized to expand or modify AFT’s warranty obligations unless such modification is expressly agreed to in writing by an authorized representative of AFT.

WEBSITE TERMS OF USE

DISCLAIMER OF WARRANTIES

The materials on Atech Flash Technology’s websites are provided “AS IS” without any representations or warranties whatsoever.

Atech Flash Technology (“Atech”) makes no representations or warranties, express or implied, regarding such materials and disclaims all representations and warranties regarding such materials, including, without limitation, any implied warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property rights or other rights.

Further, Atech makes no representations or warranties concerning the accuracy, completeness, results, or reliability of the use of the materials on its websites or otherwise relating to such materials or any websites linked to or from Atech’s websites.

LIMITATION OF LIABILITY

To the extent permitted by applicable law, in no event shall Atech or its suppliers be liable for any direct, indirect, incidental, special, consequential, or other damages whatsoever, including, without limitation, damages for loss of data, loss of profits, or business interruption, arising out of the use of or inability to use the materials on Atech’s websites, even if Atech has been notified orally or in writing of the possibility of such damages.

Some jurisdictions do not allow certain exclusions or limitations of implied warranties or liability for incidental or consequential damages. Therefore, some of these exclusions or limitations may not apply to you.

REVISIONS AND ERRATA

The materials appearing on Atech’s websites may include technical, typographical, or photographic errors. Atech does not represent or warrant that any of the materials on its websites are accurate, complete, or current.

Atech may make changes to the materials contained on its websites at any time without notice. Atech does not, however, make any commitment to update such materials.

MODIFICATION OF TERMS OF USE

Atech may revise these Terms of Use for its websites at any time without notice. By using any part of Atech’s websites, you agree to be bound by the then-current version of these Terms of Use.

USER SUBMISSIONS

Any information, data, or other material you transmit or post to Atech’s websites will be considered non-confidential and non-proprietary (“Submitted Information”), except where otherwise stated in an applicable privacy policy or agreement.

Subject to applicable law and any applicable privacy policy or agreement, Atech will have no obligations with respect to the Submitted Information and may, at its option, use, reproduce, disclose, distribute, copy, or incorporate such Submitted Information for lawful commercial or non-commercial purposes.

You may not transmit or post any material to Atech’s websites that is unlawful, threatening, abusive, defamatory, obscene, infringing, or otherwise violates applicable law or the rights of any third party.
